Information clause for the transfer of data to third countries or international organisations



1. Personal Data Controller
The Controller of the personal data which you provided shall be:

entered into the Register of Entrepreneurs of the National Court Register by the District Court for the capital city of Warsaw, 12th Commercial Register of the National Court Register, under KRS no. 0000109815, with the share capital of PLN 138,006,600.00 and NIP no. 526-030-01-67.

2. Data protection officer
The contact person in all matters pertaining to the protection of personal data shall be the Data Protection Officer, available at: iod@paih.gov.pl.

3. Purposes of and Grounds for Processing
The personal data, consisting of the name and surname, e-mail address, contact number, shall be processed by PAIH S.A. for the following purposes:
I. in order to bring economic operators together and establish international cooperation by transferring contact details to third countries or international organisations (pursuant to Article 49 (1) point a) of GDPR). The transfer shall be made upon an additional consent and stems from the justified interest of the Controller and the data subject, i.e. the promotion of Polish economy around the world and assistance for Polish entrepreneurs with pursuing international markets.
II. in order to carry out tasks related to the promotion of Polish economy under the act on the promotion of Polish economy by Polish Investment and Trade Agency (Polska Agencja Inwestycji i Handlu Spółka Akcyjna] of 7 July 2017 (Journal of Laws [Dz.U.] of 2017, item 1491) - pursuant to Article 6 (1) point a) of GDPR.
III. for other purposes related to business activity, including the implementation of lawfully justified interests related to the necessity to exercise claims connected with carried out tasks - pursuant to Article 6 (1) point f of GDPR.

4. Personal Data Recipients
The personal data of the data provider may be transferred to:
  • third countries or international organisations (pursuant to Article 49 (1) of GDPR);
  • operators cooperating under personal data processing agreements, including subcontractors providing services, and providers of ICT services and technical equipment;
  • operators of the Polish Development Fund (PFR) Group (PER, PER Venture, PER TEI S.A., KUKE S.A., PARP, ARP S.A., BGK);
  • operators supervising the operation of PAIH S.A. (Minister for economy, Prime Minister);
  • regional partners from the Investor Support Centres and Special Economic Zones;
  • other economic operators cooperating with PAIH S.A. outside of the European Economic Area.

5. Risk Connected with the Transfer to Third Countries or International Organisations
Your data may be transferred to an organisation which does not ensure an appropriate level of data protection, provided for by the provisions of law in Poland, in particular, the provisions of GDPR. Therefore, pursuant to Article 49 (1) point a) of GDPR, we would like to inform you that we do not provide appropriate safeguards provided for in Article 46 of GDPR. As it is impossible to conclude standard contractual clauses with the data recipient, or the lack of binding corporate principles, we would like to inform you that there is a risk of insufficient protection of your data.

An additional consent to the transfer of your personal data to an operator located in a third country is necessary, as there is a potential risk that your data will be stored without adhering to the requirements provided for in GDPR.

6. Personal Data Storage Period
Your personal data shall be stored and processed by the time you request to have them erased, to have their processing limited, to lodge an objection to processing or transferring them, or as long as PAIH S.A. carries out its tasks related to the promotion of Polish economy.
In order to exercise legal claims within the time limit of period of limitation for certain claims stemming from the relevant legal relation.

7. Rights of the Data Subjects
Subject to the restrictions referred to in GDPR, everyone has the right to:
  • access their data and receive their copy;
  • rectify (correct) their personal data;
  • limit the processing of personal data;
  • erase personal data;
  • lodge a complaint to the President of the Personal Data Protection Office (to the address of the Office, ul. Stawki 2,00 - 193 Warszawa).
Each consent may be withdrawn at any time, without affecting the lawfulness of processing carried out prior to the withdrawal.

8. Information on the Requirement to provide Data
The provision of the personal data is voluntary, however, necessary for the purposes referred to in point 3.
