Pursuant to OECD Guidelines for Multinational Enterprises, the governments of adhering countries committed to create OECD National Contact Points.
The purpose of OECD National Contact Points (NCPs) is to promote and ensure adherence to OECD Guidelines. Apart from promoting OECD Guidelines, NCPs are tasked with considering complaints filed against multinational enterprises in breach of the Guidelines. The Polish NCP was founded in 1998 and since 2001 is located at Polska Agencja Informacji i Inwestycji Zagranicznych S.A. (Polish Information and Foreign Investment Agency). National Contact Points operate in all 34 OECD member countries and 11 non-OECD adhering countries (Argentina, Brazil, Columbia, Egypt, Lithuania, Latvia, Morocco, Peru, Romania, Tunisia, Costa Rica). While Jordan does not have a National Contact Point, it declared adherence to the Guidelines in Nov 2013.
Guidelines are recommendations in the scope of standards of responsible conduct in business, directed by governments to enterprises whose operations in any way exceed beyond the boundaries of one country. They form a collection of principles and standards encompassing various areas from human rights, employment rights and safety at work, through access to information, taxation, environment protection and due diligence of business operations. Adherence to the Guidelines is mandatory for enterprises seated in one of the countries that are signatory to the Guidelines everywhere they conduct business activity.
As part of the procedure of considering complaints regarding breach of OECD Guidelines, a complaint regarding such breach may be filed with an OECD NCP. In such case the NCP is obliged to examine the case and, where justified, propose mediation proceedings to the parties. The purpose of mediation is to find an amicable solution to the problem by the parties.
